Agreement

These terms govern your use of HardwareVitals at https://hardwarevitals.com (the “Site”), operated by HardwareVitals. Using the Site means you accept them. If you do not accept them, please do not use the Site.

What the Site is

The Site provides a free hardware test suite. There is no account, no subscription and no charge. We may change, suspend or discontinue any part of it at any time, without notice and without liability to you.

No warranty

THE SITE AND EVERYTHING ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

In plain language: we work hard to make the results correct, but we do not guarantee that they are, that the Site will always be available, or that it is free of errors.

Not professional advice

Results produced by the Site are for general information only and are not medical, safety, repair or other professional advice. They are not a substitute for the judgement of a qualified professional, and no professional relationship is created by your use of the Site.

Verify any result independently before acting on it, and especially before relying on it for anything involving money owed to another person, legal obligations, health, safety, or engineering tolerances.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER WE NOR ANYONE INVOLVED IN PRODUCING THE SITE WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR ANTICIPATED SAVINGS, ARISING OUT OF OR CONNECTED WITH YOUR USE OF, OR INABILITY TO USE, THE SITE — EVEN IF WE HAVE BEEN ADVISED THAT SUCH DAMAGES ARE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR CONNECTED WITH THE SITE, ON ANY THEORY OF LIABILITY, WILL NOT EXCEED ONE HUNDRED US DOLLARS (USD 100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limits above apply to the greatest extent the law allows, and nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

How you may use the Site

You may use the Site for any lawful purpose, including commercial work, at no charge. You may not:

• use it in any way that breaks the law or infringes anyone’s rights;
• attempt to gain unauthorised access to it, or interfere with its normal operation;
• impose an unreasonable load on it, including through automated scraping that ignores robots.txt or degrades service for others;
• strip, obscure or block notices, attribution or advertising in a redistributed copy of a page;
• present the Site as your own or imply an endorsement or affiliation that does not exist.

Content and intellectual property

The design, text and code of the Site belong to us or our licensors. Individual results you generate are yours — a converted figure or a calculated total carries no claim from us, and you may use it freely, including commercially.

If you believe material on the Site infringes your copyright, write to contact@hardwarevitals.com identifying the material and your rights in it, and we will investigate and remove anything infringing.

Advertising and third-party links

The Site carries third-party advertising and may link to other sites. We do not control them, do not endorse them, and are not responsible for their content, products or privacy practices. Your dealings with any advertiser are between you and them.

Some outbound links may be affiliate links, meaning we may earn a commission if you buy something after following one. This never changes what we recommend or costs you more.

Indemnity

You agree to indemnify and hold us harmless from any claim, loss or expense (including reasonable legal fees) arising from your misuse of the Site or your breach of these terms.

Governing law

These terms are governed by the laws of Israel, without regard to its conflict-of-laws rules, and the courts of Israel have exclusive jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory laws of your country of residence.

Severability and changes

If any provision is held unenforceable, the rest remains in force. We may update these terms; the version published here is the one that applies, and material changes will be reflected in the date below.
